In 1995 the European Union adopted a series of directives (now in force across the EU), dealing with privacy of users of LBS, which are the subject of ongoing amendments to keep them relevant to changing technology. According to the EC directives regarding privacy (95/46/EC, 97/66/EC, and 2002/58/EC IV), three key principles must be followed when deploying LBS: disclosure, consent, and data security. The main thrust behind each principle is summarized here:
Disclosure— Any company that acts as a location data collector should disclose to consumers what kind of data is being collected about them and the purpose or use of such collection. Transparency by the data collector is key within this principle.
Consent— The data collector should obtain the data subject’s consent before collecting their personal data. This is also referred to as opt in and opt out for the use of location.
Data security— Data collected should be protected by adequate security measures against accidental loss, theft, disclosure, destruction, illegal processing, or something similar. Archiving of personal location data can be done only with the explicit approval of the user.
