8. Employees Who Are a Different Race from Most

Race is the original protected category under Title VII. As with gender and women, it's important to remember that there's no such thing as “reverse” discrimination. Blacks and whites (and members of any other race) all enjoy the same protection against race discrimination under Title VII and the state-law analogues.

But as women are more likely to bring and prevail in a sex-discrimination lawsuit, minorities are more likely to raise a race-discrimination claim than whites are. Similarly, experienced plaintiffs' attorneys are likely to talk white would-be plaintiffs out of bringing a race claim. For this reason, firing an employee of a different race is riskier than firing a white employee.
